Chosen Rewards Store is the Rewards program that the product is purchased and sold from.
Accepted Payment Card means any credit card or debit card which a Member may use to make a payment, and include Visa and MasterCard, and such other cards as accepted by or on behalf of the Chosen Rewards Store.
Products mean any product or service available from time to time at the Rewards Store.
1.1 To sell via the Towster Store you have to be a Chosen Rewards Store member.
1.2 Products will only be available through the Chosen Rewards Store from the time the chosen company posts the Product on the Rewards Store.
1.3 The Chosen Rewards Store may, without notice withdraw, change, cancel or increase the availability of a Product or modify the number of Points or the Points + Pay proposition for a Product.
1.4 Product that will be purchased via the nominated Rewards store will be sent to the buyer via their nominated address.
1.5 Upon purchase buyers can not change their mind or return goods unless they are faulty.
1.6 Ordering product is subject to Chosen Rewards Store policies.
1.7 Products ordered will not be despatched until payment has been accepted.
1.8 Seller won’t receive funds until the buyer has received goods.
1.9 Seller has to abide by the chosen awards program policies otherwise payment won’t be processed.
1.9a Towster takes no responsibility or liability for errors or failures by third parties as part of the delivery process.
2.1 All delivery addresses which a buyer provides for purchases through the Chosen Rewards Store must be physical addresses in the required countries by the Chosen Rewards Store. Post office box addresses will not be accepted.
2.2 Products purchased through the Chosen Rewards Store will be delivered within the chosen rewards store terms.
3.1. As consumers, buyers are entitled to the benefit of statutory consumer guarantees in respect of Products purchased or redeemed from the Chosen Rewards Store. In accordance with the Australian Consumer Law (in Australia) and the Consumer Guarantees Act (in New Zealand), as applicable, if a product has a major failure, a buyer may reject the product and seek a replacement or refund. A buyer is also entitled to have a product repaired or replaced if it fails to be of acceptable quality and the failure does not amount to a major failure. Further information on these rights can be obtained by accessing the Australian Competition and Consumer Commission (ACCC) government website, or for New Zealand by accessing the consumer protection government website. Nothing in these terms limits or excludes a Member’s statutory rights as a consumer under the Australian Consumer Law or Consumer Guarantees Act (NZ) or under any other applicable legislation where it is unlawful or ineffective for the Member’s rights to be limited or excluded.
3.2 Refunds or replacements are not provided where a buyer has a change of mind or has made a wrong selection. Buyers should carefully check their order before completing a purchase through the Chosen Rewards Store.
3.3 Products are unable to be replaced if stolen, lost, damaged, destroyed or otherwise altered after delivery to the delivery address nominated by the buyer (unless due to a cause which breaches the buyers statutory rights). We recommend buyers inspect any Product as soon as possible after delivery to ensure it matches the description provided.
3.4 If a buyer requests a refund in respect of a Product, then consistent with any statutory obligations, a refund of the purchase price (including delivery charges, if applicable) will be made through the seller and the Chosen Rewards Store process and compliance.
3.5 Subject to clauses 4.1 and any statutory rights of a buyer which cannot be excluded, Towster:
(a) do not endorse or warrant any guarantees, conditions, warranties, representations, brands or Products that are accessible through the Chosen Rewards Store. You might notice that certain Products have additional conditions specified by the merchant. To the extent that those conditions are inconsistent with these terms and conditions, these terms and conditions will supersede those provided by the merchant;
(b) disclaim all liability arising for any and all guarantees, conditions, warranties or representations with respect to the type, quality, standard, fitness or suitability for any purpose, of any Product obtained through the Chosen Rewards Store; and
(c) will not be liable to buyers or any other person for any and all loss, claim, damages or expenses arising in connection with use of the Chosen Rewards Store, Products obtained through the Chosen Rewards Store or any interaction or transaction in connection with the Chosen Rewards Store.
4. Purchase Alcohol Products
4.1 Buyers must be 18 years or over to purchase alcoholic Products through the Chosen Rewards Store.
4.2 It is against the law to sell or supply alcohol to, or to obtain alcohol for or on behalf of, a person under the age of 18 years.
4.3 Orders for alcoholic Products (including gift cards which are only able to be redeemed at merchants that sell alcohol) are fulfilled by licensed suppliers.
4.4 By ordering alcoholic products through the Chosen Rewards Store, you warrant that:
(a) you are aged 18 years or over; and
(b) any person for whom you are obtaining the alcoholic Products, or to whom you will supply the alcoholic Products, is aged 18 years or over.
4.5 The licensed supplier, or it’s delivery agent, of the alcoholic products that have been ordered by the Member, may:
(a) require the recipient to produce photographic identification to prove that the recipient is at least 18 years of age; and
(b) refuse to deliver the alcoholic Products if adequate proof of age is not supplied. If such delivery is refused, the Points redeemed by the Member for that purchase will be forfeited.
